Many people are worried or nervous about the bankruptcy process. There’s a lot of legal jargon involved, like the Means Test, Meeting of the Creditors and much more. We’re here so you don’t have to be worried! This is the first in a series of posts we’ll be doing on what you can expect when you choose to file bankruptcy and why it makes sense to call us. Having Rank & Karnes Law on your team will immediately give you peace of mind and the assurance that the process will go smoothly.
Meeting of the Creditors
You’ll often hear this referred to as a bankruptcy hearing. This is one of the things our clients are often most nervous about. This is also one of the biggest reasons to file with us. Your Rank & Karnes attorney will personally attend this meeting with you. Before your meeting, we will go over all your paperwork with you and answer any of your questions. When you walk in the door you’ll be confident that all your paperwork is present, accurate and filed correctly.
This makes the Meeting of the Creditors itself a breeze. You and your attorney will meet with someone called the bankruptcy trustee. Most hearings take only 5-10 minutes. Creditors themselves very rarely attend the meeting. It is basically an opportunity for the bankruptcy trustee to meet you, confirm your identity and go over the paperwork we’ve helped you file. When you go with us, there won’t be any surprises, and we’ll just be certifying that we’ve filed accurate and complete schedules as set by the court. In a Chapter 13 bankruptcy, this is also an opportunity to talk through final plan provisions, payments and schedules.
See It Happen
Still wish you could picture what it will all be like? We can help! The Oregon Bankruptcy Court has provided a video of a Meeting of the Creditors. You can see exactly what happens and what the process will look like for you. But unlike this woman you won’t be alone, and you’ll have everything you need the first time.
